South Pender committee rejects attached-garage floor-area exemption

The South Pender Island Local Trust Committee defeated a motion to exclude an attached garage of up to 46 square metres or 500 square feet from a dwelling’s floor area under draft Land Use Bylaw No. 129.^[1] The minutes record the motion as defeated, without giving a vote count.^[1]

The committee discussed whether including attached garages in the maximum dwelling area would reduce the allowable size of a home, while detached garages would not count toward that limit.^[1] Comments recorded in the minutes included arguments about environmental effects, flexibility for property owners and limiting building sizes.^[1]

The meeting also considered a possible single-table format for floor-area limits, with categories for lot size, total floor area of all buildings, dwelling floor area and legal dwellings built before September 15, 2022.^[1] The minutes say the chair and planner acknowledged that one table provided greater clarity and relieved some public distress about homes being labelled legal non-conforming.^[1]

The committee discussed seeking a public-facing legal opinion on the bylaw’s effects on legal non-conforming status after settling the draft’s wording and floor-area limits.^[1] Trustee Evans said the planner would need to amend the Project Charter to budget for a legal opinion.^[1]
